Second Ordinary Session - Third Legislative Term
First item:
Reading the names of the members who apologized for not being able to attend and those how were absent from the previous session
• The members: Rabab Abdulnabi Al-Arrayedh, Hamad Mubarak Al-Naimi, Khalid AbdulRasool Al Sharif, Khalil Ebrahim Al-Zawadi, Lulua Saleh Al-Awadi and Mohammad Hadi Ahmad Al-Halwachi apologized about not being able to attend the session. None of the members was absent from the previous session.
Second item:
Ratification of the minutes of the previous session
The minutes were ratified without any changes.
Third item:
Correction on pages 13 and 26 of the minutes of the 25th session (ratified)
• Approval of the correction on pages 13 and 26 of the minutes of the 25th session (ratified) by changing the Council’s decision on article 2 from “the approval to change the committee” to “approval of the change raised in the session”.
Fourth item:
Received messages:
a- The Council was informed of referral to the Foreign Affairs, Defense and National Security, of the decision of the Council of Representatives on the Decision of the Shura Council regarding a draft law providing for amendment of certain articles of the penal code promulgated by decree by law No.15 for the year 1976, accompanying royal decree No.10 for the year 2010, “incrimination of bribery and embezzlement in the private sector”
b- The Council was informed of the referral of a draft law for amendment of certain articles of the Public Security Forces laws, promulgated by decree by law No.3, for the year 1982, to the Foreign Affairs, Defense and National Security.
c- The Council was informed of the referral, to the Public Utilities and Environment Committee, of a draft law on limitation of ownership by non-Bahraini nationals of built real estate and residential non-investment lands.
d- The Council was informed of the referral to the Services Committee of a proposed law for amendment of certain articles of law No.13, for the year 1975, on regulation of the retirement pensions and rewards of government employees, filed by Their Excellencies the members: Abdul Rahman Ebrahim Abdul Salam, Abdul Rahman Abdul Husain Jawahri, Abdul Rahman Mohammad Jamsheer, Dr. Nada Abbas Haffaz and Said Habib Makki Hashim
Fifth item:
Report by the Foreign Affairs, Defense and National Security on a draft law for ratification of an agreement between the Government of the Kingdom of Bahrain and the Government of Spain, on encouragement and exchange of protection of investments, accompanying Royal Decree No.23 for the year 2012
- Approval of the draft law in principle.
- Approval of the following articles as received from the government (the preamble, first and second articles)
- Approval of the draft law in its entirety, subject to taking final opinion thereon after the passage of one hour.
- Final approval of the draft law on an expedited basis and referral thereof to His Royal Highness the Prime Minister in preparation for ratification by His Majesty the King.
Sixth item:
Report by the Foreign Affairs, Defense and National Security on a draft law for ratification of a protocol for amendment of an agreement for avoidance of double taxation and income tax evasion between the Government of the Kingdom of Bahrain and the Government of the Republic of Singapore, accompanying royal decree No.24 for the year 2012
- Approval of the draft law in principle.
- Approval of the following articles as received from the government (the preamble, first and second articles)
- Approval of the draft law in its entirety, subject to taking final opinion thereon after the passage of one hour.
- Final approval of the draft law on an expedited basis and referral thereof to His Royal Highness the Prime Minister in preparation for ratification by His Majesty the King.
Seventh item:
Supplementary report by the Legislative and Legal Affairs Committee on the decision of the Council of Representative about the Shura Council’s decision on a draft law for amendment of certain articles of decree by law No.21 for the year 1976, providing for regulation of real estate auction business, accompanying royal decree No.59 for the year 2007.
- Approval to stick to article three (13 repeated) as worded in the previous decision of the Shura Council.
- Approval of the draft law in its entirety subject to taking final opinion thereon in the upcoming session.
Eighth item:
Supplementary report by the Legislative and Legal Affairs Committee on a draft law for amendment of certain articles of decree by law No.14 for the year 1971, on authentication, accompanying royal decree No.87 for the year 2008
- Approval of the first article (1 repeated) as amended by the committee.
- Approval of the draft project in its entirety, subject to taking final opinion thereon in the upcoming session.
Ninth item:
Report by the Legislative and Legal Affairs Committee on the decision of the Council of Representative about the Shura Council’s decision on a draft law on consumer protection, accompanying royal decree No.2 for the year 2009, and a draft law on consumer protection in response to a proposed law filed by the Shura Council
- Approval of article 17 as worded in the last decision of the Council of Representatives.
- Approval of the draft law in its entirety subject to taking final opinion thereon on an expedited basis
- Final approval of the draft law on an expedited basis and referral thereof to His Royal Highness the Prime Minister in preparation for ratification by His Majesty the King.
Tenth item:
Report by the Foreign Affairs, Defense and National Security on a draft law on computer and cyberspace crimes, accompanying royal decree No.47 for the year 2009, and a draft law on computer crimes, prepared in response to a proposed law filed by the Council of Representatives
- Approval of returning the said report to the committee for further review and study.
* The following two reports were read at the beginning of the session:
• Statement on applaud of the royal speech offered by His Majesty the King on the occasion of ratification of the constitutional amendments.
• Statement on denouncement and condemnation of the terrorist act which targeted the lives of security men in Bani Jamrah village.
